Terms of Service

Please read these carefully. By using puku, you agree to these terms.

Effective date: 1 June 2025

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Aryal Technologies Pty Ltd (ABN 33 692 831 459) ("puku", "we", "us", "our") governing your access to and use of the puku iOS application and website (collectively, the "Service").

By creating an account, downloading the app, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use puku.

The Service

puku is an AI-powered personal styling app that helps you create outfit combinations from your existing wardrobe. Core features include:

  • Wardrobe management and AI categorization of clothing items
  • AI-generated outfit suggestions based on natural language prompts
  • Outfit visualization on a body figure
  • Saved looks and outfit history
  • Face ID authentication (optional)

puku is currently in early access / beta. Features, availability, and functionality may change at any time without notice.

Geographic Availability

puku is currently only available in selected countries. Access from unsupported regions is at the user's own risk.

The Service is operated from Australia and is currently made available only in jurisdictions where we have determined it is appropriate to do so. We make no representation that the Service is available, lawful, or appropriate for use in your location.

If you access the Service from a country or region where it is not officially supported, you do so at your own risk and are solely responsible for compliance with any local laws and regulations that may apply to you. We are not liable for any consequences arising from access to the Service from unsupported jurisdictions.

We reserve the right to restrict, block, or terminate access from any country or region at any time and without notice.

Your Account

Eligibility

You must be at least 13 years old to use puku. Users aged 13–17 require parental consent. By creating an account, you represent that you meet these requirements.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@aryal.com.au if you suspect unauthorized access to your account.

One Account Per Person

Each person may maintain only one active account. Accounts are personal and non-transferable.

Your Content

Ownership

You retain ownership of all photos, prompts, and other content you upload to puku ("Your Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely to provide the Service to you.

Your Responsibilities

You represent and warrant that:

  • You own or have the right to upload all content you provide
  • Your content does not violate any applicable law or third-party rights
  • Your content does not contain illegal, harmful, or offensive material
  • Photos submitted for AI processing depict clothing items only (for the purpose of outfit generation)

Content Moderation

We reserve the right to remove any content that violates these Terms or that we reasonably determine is harmful, illegal, or inappropriate.

AI Features

puku uses Claude AI (developed by Anthropic) to provide outfit generation and item categorization. By using these features, you acknowledge:

  • AI-generated content may not always be accurate, appropriate, or to your taste
  • Outfit suggestions are for informational and styling purposes only
  • Your prompts and relevant wardrobe data are transmitted to Anthropic's API to generate responses
  • You should not rely on AI suggestions for safety-critical decisions
  • AI behavior may change as underlying models are updated

puku's AI features are provided "as is" and we do not guarantee specific results or outcomes from AI-generated content.

Acceptable Use

You agree not to use puku to:

  • Violate any applicable law or regulation
  • Upload content that is illegal, harmful, offensive, or that infringes third-party rights
  • Attempt to gain unauthorized access to our systems or another user's account
  • Reverse engineer, decompile, or attempt to extract the source code of the app
  • Use automated tools, bots, or scripts to access or scrape the Service
  • Circumvent or disable any security features
  • Use the Service for any commercial purpose not authorized by us
  • Interfere with the operation of the Service
  • Create accounts for other people without authorization

Violation of acceptable use may result in immediate account suspension or termination.

Intellectual Property

All rights in the puku app, including the software, design, interface, brand, logo, and any content we create, are owned by Aryal Technologies Pty Ltd and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable license to use the puku app on your iOS device for personal, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, sublicense, or create derivative works based on any part of the Service without our prior written consent.

Indemnification

You agree to indemnify, defend, and hold harmless Aryal Technologies Pty Ltd and its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any content you upload, submit, or transmit through the Service
  • Your access to the Service from a jurisdiction where it is not officially supported

We reserve the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defences.

Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

To the fullest extent permitted by law, we disclaim all warranties including:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranty that the Service will be uninterrupted, error-free, or secure
  • Warranty as to the accuracy of AI-generated outfit suggestions
  • Warranty that defects will be corrected

We do not guarantee that the Service will meet your expectations or requirements. AI-generated outfit suggestions are for informational and entertainment purposes only and do not constitute professional styling, fashion, or any other professional advice.

puku is not responsible for any purchasing decisions, financial commitments, or other actions you take based on AI-generated content.

Limitation of Liability

To the maximum extent permitted by applicable law, Aryal Technologies Pty Ltd and its officers, directors, employees, and agents will not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profit, revenue, or goodwill
  • Damages arising from AI-generated content or outfit suggestions
  • Service interruptions or errors
  • Unauthorized access to your account

Our aggregate liability to you for any claim related to the Service shall not exceed the greater of AUD $50 or the amount you paid us in the 12 months preceding the claim.

Termination

You may stop using puku and delete your account at any time via Settings → Account → Delete Account.

We reserve the right to suspend or terminate your account immediately if we determine that you have violated these Terms, engaged in fraudulent or illegal activity, or if your use of the Service poses a risk to us or other users.

Upon termination, your license to use the Service ceases and we will delete your data as described in our Privacy Policy.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of the Service.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and puku regarding the Service.
